How this Appendix works with the Terms & Conditions: this Appendix forms part of the Terms. Where it covers a matter in more detail, the provisions of this Appendix apply.
2. Prices and payment
-
Current prices and packages are published on the Platform: https://mathema.me/en/product/
-
Prices may change. Any change is published at the link above and applies to future orders only.
-
The price of your order is fixed at the moment of payment. Mathema cannot change it until all services you have already paid for have been delivered.
-
Payments are cashless and processed by authorised third-party payment providers, so that payment is fast and secure.
-
On request, you may also pay by direct bank transfer. Depending on which Mathema entity provides the service, VAT may be added to this payment method. We will tell you before you complete the order.
3. Refunds
3.1 When we refund
Mathema refunds the unused Balance — money you have paid to Mathema that has not yet been used for lessons already delivered — in the following cases:
|
Case |
Condition |
|---|---|
|
We cannot arrange lessons |
We cannot assign or replace a Tutor within 14 days of notifying you. |
|
Lessons stopped through our fault |
No lessons took place for at least 14 consecutive days due to Mathema or the Tutor, and no break was agreed with the Tutor or with Mathema beforehand. |
|
You change your mind before lessons start |
You request a refund within 14 days of paying for a package or a diagnostic lesson, and no lesson has taken place yet. |
⚠️ Only the unused Balance is refundable. Lessons that have already been delivered are not refunded.
Nothing in this section limits your mandatory statutory rights as a consumer, including the right to withdraw from a distance contract within 14 days under applicable EU consumer law or the law of your country of residence.
3.2 How to request a refund
-
Contact support by email at [email protected] or through the chat on the Platform.
-
Provide the details we need to identify you and your payment: full name, email, phone number, date and amount of the transaction, and your bank account details.
-
We review the request and, if it meets the conditions in section 3.1, process the refund within 30 days of the request.
Additional rules:
-
Refunds are made only to the Client's bank account.
-
The refund equals the full remaining Balance. No service fee is deducted.
-
Refunds are made only in the cases and in the manner set out in these Terms.
💡 You can ask support to confirm your current Balance at any time before submitting a request.
4. Accepting the Terms
These Terms, together with the documents linked in them, are an offer addressed to users of the Platform and are accepted as standard terms.
Placing an order on the Website with the requested details and paying for it confirms your clear, informed and unconditional acceptance of these Terms and has the same effect as your signature.
The agreement between you and Mathema remains in force until the last lesson you have paid for has been delivered, except where the money is refunded under section 3.
5. Intellectual property
All intellectual property available on the Website or made available to you while services are provided — texts, images, design, graphics, information, logos, audio and video recordings, interfaces, software and similar — is either owned by Mathema or used by Mathema with the rightsholder's permission.
⚠️ You may use these materials only for your own participation in the services. Any other use is prohibited, unless this Appendix expressly allows it or the Website clearly states otherwise.
6. Force majeure
Mathema and the Client are released from liability for partial or full failure to perform their obligations where performance is prevented by an extraordinary and unavoidable event, including but not limited to:
-
military action, civil unrest or sabotage;
-
natural disasters;
-
power, internet or telecommunications outages;
-
state restrictions that make the proper operation of Mathema impossible;
-
any other circumstances that objectively prevent Mathema from providing services properly and on time.
In such cases the deadline for performing obligations is postponed for as long as the circumstances and their consequences last, until Mathema and the Website are fully operational again.
Mathema will publish information about force majeure events, and about their end, on the Website without undue delay.
7. Confidentiality and personal data
-
Information received by Mathema from the Client, or by the Client from Mathema, while services are provided is confidential.
-
Neither party discloses the other party's confidential information without consent, except where disclosure is required by law or by a competent authority.
-
Both parties take appropriate measures to keep confidential information from becoming known to third parties.
-
Passing confidential information to third parties, or disclosing it in any other way, requires the written consent of the other party.
-
Liability for disclosing confidential information and for any resulting damage follows applicable law.
Personal data. Mathema processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and other applicable data protection laws. What we collect, why, on what legal basis, who we share it with, how long we keep it, and what rights you have — including access, correction, erasure, objection, portability, withdrawal of consent, and the right to complain to a supervisory authority — is described in the Privacy Policy.
Where personal data is transferred outside the European Economic Area, Mathema applies EU Standard Contractual Clauses or other appropriate safeguards.
8. Governing law and disputes
- These Terms are governed by and interpreted in accordance with the laws of the Republic of The United States of America excluding conflict of law rules.
-
If a dispute arises, please contact us first — most issues are resolved through support.
- If the dispute cannot be resolved through negotiation, it is submitted to the competent courts of The United States of America, unless mandatory law provides otherwise.
-
Disputes arising directly between a Student and a Tutor under a Tutoring Agreement are resolved under the law applicable to that agreement.
⚠️ Nothing in this section limits mandatory consumer rights granted by EU law or by the law of your country of habitual residence.
9. Changes to the Terms
-
Mathema may change, supplement or remove provisions of these Terms, in whole or in part, by publishing the updated version on the Website.
-
Please check the Website from time to time. Continuing to use the services after a change means you accept it.
-
Significant changes are announced separately on the Website.
-
Changes do not affect the price or quantity of services you have already ordered and paid for.
-
Changed provisions take effect 10 days after the new version is published.
-
On request, Mathema provides the version of the Terms that applies to the services you have already ordered and paid for.
10. Availability of the Platform and liability
-
Access to the Website and the services is provided "as is".
-
Unless this Appendix expressly states otherwise, Mathema gives no warranties in relation to the Website and the services, to the maximum extent permitted by law.
-
Mathema does not warrant that the Website will work without interruption or errors, and is not liable for related delays in providing services.
-
Mathema is not liable if information, materials or content on the Website, or made available while services are provided, is inaccurate or incomplete, or contains typographical errors.
-
To the maximum extent permitted by applicable law, Mathema, its employees and contractors are not liable for direct or indirect losses, including lost profit, arising from the use of, or inability to use, the Website or the services, or from errors, defects and interruptions in the operation of the Website.
⚠️ These limitations apply only as far as the law allows. They do not exclude Mathema's liability for intentional misconduct or gross negligence, and they do not affect your mandatory rights as a consumer.
11. Marketing and reviews
By providing your details you consent to receiving marketing communications from Mathema and to the publication of your personal reviews of the services.
You can withdraw this consent at any time — use the unsubscribe link in any email or contact support.
